DMCA Policy

Chekodi respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws, we have implemented procedures for receiving and responding to notifications of alleged copyright infringement.

If you believe that content on Chekodi infringes your copyright, please follow the procedures outlined below to submit a takedown notice.

1. Filing a DMCA Takedown Notice

If you are a copyright owner or authorized to act on behalf of a copyright owner, and you believe that content on Chekodi infringes your copyright, you may submit a DMCA takedown notice to our designated Copyright Agent. Your notice must include the following information:

  • Identification of the copyrighted work: A description or link to the copyrighted work that you claim has been infringed
  • Identification of infringing material: The specific URL or location of the content on Chekodi that you claim is infringing
  • Your contact information: Your name, address, telephone number, and email address
  • Good faith statement: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  • Accuracy statement: A statement that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner
  • Signature: Your physical or electronic signature

2. How to Submit a DMCA Takedown Notice

Please include "DMCA Takedown Notice" in the subject line of your email for faster processing.

3. What Happens After You Submit a Notice

  • We will review your notice to ensure it contains all required information
  • If your notice is complete and valid, we will remove or disable access to the allegedly infringing content
  • We will notify the user who posted the content about the takedown
  • We may provide the user with your contact information so they can respond directly
  • We will keep a record of the takedown notice in accordance with legal requirements

4. Counter-Notification Process

If you believe that your content was removed in error, you may submit a counter-notification. Your counter-notification must include:

  • Identification: Identification of the content that was removed and its location before removal
  • Good faith statement: A statement under penalty of perjury that you have a good faith belief that the content was removed as a result of mistake or misidentification
  • Consent to jurisdiction: Your consent to the jurisdiction of the federal court in your location, or if outside the United States, your consent to the jurisdiction of any judicial district where Chekodi may be found
  • Contact information: Your name, address, telephone number, and email address
  • Signature: Your physical or electronic signature

If we receive a valid counter-notification, we will forward it to the original complainant. The content may be restored within 10-14 business days unless the original complainant files a court action seeking a court order to restrain the user from engaging in infringing activity.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Chekodi maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. We reserve the right to terminate accounts that receive multiple valid DMCA takedown notices, even if the user submits counter-notifications.

6. False Claims and Penalties

Please be aware that submitting a false DMCA takedown notice or counter-notification may result in liability for damages, including costs and attorneys' fees. Under the DMCA, anyone who knowingly misrepresents that material is infringing may be liable for damages.

Before submitting a notice, please ensure that you have a good faith belief that the material is actually infringing your copyright and that you are authorized to act on behalf of the copyright owner.

7. Fair Use and Other Defenses

Users may have rights to use copyrighted material under the doctrine of fair use or other legal exceptions. If you believe your use of copyrighted material constitutes fair use, you may include this information in your counter-notification. However, Chekodi does not make determinations about fair use - such disputes should be resolved between the parties or through the courts.

8. Trademark and Other Intellectual Property Issues

This DMCA Policy addresses copyright infringement only. For trademark infringement, defamation, or other intellectual property concerns, please contact us directly. We will review and address such claims in accordance with applicable laws and our Terms of Service.
